Professor Bryant’s article – which seeks to discover whether aspects of an anticruelty statute can be based directly on a call to virtuous conduct – is a provocative piece of scholarship that harbors a much larger question: Can a general principle mandating full respect for animals be developed out of the moral methodology inhering in virtue ethics? Insights garnered in this rejoinder are meant to stand alongside those in Professor Bryant’s article to lend deep moral grounding to animal-respect as well (...) as provide intimations of the way virtue ethics as a moral methodology might yield determinate answers to moral questions. Toward this end, this paper has several sections. The first section briefly outlines virtue ethics as a moral methodology with particular attention to its highly situated and somewhat ad hoc aspect. The second section explores efforts over the last several decades to rely first on utilitarianism and then on deontological approaches in pursuit of moral grounding for animal respect. The third section explores the particular challenges that utilitarianism or deontology must confront in attempting to provide moral grounding for any relationship between human beings and persons or creatures that are incapable of moral agency. Finally, I turn to the concept of fiduciary duty to see if it might be viewed as a type of virtue ethics – or perhaps an instance of virtue ethics in play. (shrink)

Judith Suissa and Alice Sullivan’s 2021 paper ‘The Gender Wars, Academic Freedom and Education’ holds that activism associated with the slogan ‘trans women are women’ harms progress towards the goals of shared learning and knowledge production. They hold that shared learning and knowledge production ground the value of the university. In response, we point out that academic freedom is not absolute, and that its contribution to learning and knowledge production is only part of a host of academic goods. Given the (...) hostile environment faced by trans people in the United Kingdom, absolute academic freedom in relation to questions about sex, gender and gender identity should not be taken for granted. The focus of this paper is on the following: (1) Academic freedom is not absolute and should be responsibly curtailed when it causes harm, or hinders other educational goods; (2) public perceptions of ‘gender debates’ in the United Kingdom cause harm and hinder other educational goods; (3) academic debates about sex, gender and gender identity could contribute to this harm and hindrance and should be undertaken only with care. This essay explores the value of oppositional, performative political action in the context of oppression, domination, and exclusionary political spheres. Rather than adopting Iris Marion Young's approach, Drexler turns to Hannah Arendt's theories of political action in order to emphasize the capacity of political action as action to intervene in and disrupt the constricting, politically devitalizing, necrophilic normalizations of proceduralism and routine, and thus to reorient the importance of contestatory action as enabling and enacting creativity, spontaneity, and resistance.

Is it possible for postmodernism to offer viable, coherent accounts of ethics? Or are our social and intellectual worlds too fragmented for any broad consensus about the moral life? These issues have emerged as some of the most contentious in literary and philosophical studies. In Renegotiating Ethics in Literature, Philosophy, and Theory a distinguished international gathering of philosophers and literary scholars address the reconceptualisations involved in this 'turn towards ethics'. An important feature of this has been a renewed interest in (...) the literary text as a focus for the exploration of ethical issues. Exponents of this trend include Charles Taylor, Bernard Williams, Iris Murdoch, Cora Diamond, Richard Rorty and Martha Nussbaum, the latter a contributor and a key figure in this volume. The first is the story of four friends who came up to Oxford together just before WWII. It is the story of their lives, loves, and intellectual preoccupations; it is a story about women trying to find a place in a man's world of academic philosophy. The second story is about these friends' shared philosophical project and (...) their unintentional creation of a school of thought that challenged the dominant way of doing ethics. That dominant school of thought envisioned the world as empty, value-free matter, on which humans impose meaning. This outlook treated statements such as “this is good” as mere expressions of feeling or preference, reflecting no objective standards. It emphasized human freedom and demanded an unflinching recognition of the value-free world. The four friends diagnosed this moral philosophy as an impoverishing intellectual fad. This style of thought, they believed, obscured the realities of human nature and left people without the resources to make difficult moral choices or to confront evil. As an alternative, the women proposed a naturalistic ethics, reviving a line of thought running through Plato, Aristotle, and Aquinas, and enriched by modern biologists like Jane Goodall and Charles Darwin. Similarities between pragmatist models of democracy and deliberative models have been explored over recent years, most notably in this journal ( Talisse 2004). However, the work of Iris Marion Young has, thus far, not figured in such comparative analyses and historical weighing of pragmatist antecedents in deliberativist work. In what follows, I wish to redress this oversight by placing Young in conversation with John Dewey and Jane Addams. Young's particular brand of deliberative theorizing focuses on the inclusion of (...) women and all those deemed Other in our democracies. She identifies a significant shortcoming in standard expositions of deliberative thought, pointing out that communicative style, structured by oppressive norms of gender, race, and class, to name but a few, may serve to undermine our full participation in political decision making. While this forms a valuable insight for those seeking to redress the exclusion of Others in democracies, it also draws attention to the centrality of differences of communication in deliberative settings. In what follows, I will highlight the integral role played by communication in Young's and Dewey's expositions of democracy while showing that Addams foreshadows Young's principal insight through an appreciation of communicative difference and its attendant political implications. In Gendered Readings of Change, Clara Fischer develops a unique theory of change by drawing on American philosophy and contemporary feminist thought. Via a select history of ancient Greek and Pragmatist philosophies of change, she argues for a reconstruction of transformation that is inclusive of women's experiences and thought. We have investigated the emotional profile of dreams and the relationship between dream emotion and cognition using a form that specifically asked subjects to identify emotions within their dreams. Two hundred dream reports were collected from 20 subjects, each of whom produced 10 reports. Compared to previous studies, our method yielded a 10-fold increase in the amount of emotion reported. Anxiety/fear was reported most frequently, followed, in order, by joy/elation, anger, sadness, shame/guilt, and, least frequently, affection/eroticism. Unexpectedly, there was no (...) significant difference in the profiles of emotion reported by men and women. When the reports were scored for bizarreness, a significant correlation was found between the occurrence of bizarreness and major shifts in emotion. These results support the conclusion that dreaming is a mental state whose general emotional features are widely shared across individuals and strongly linked to cognitive features within individual dreams. The banner of deliberative democracy is attracting increasing numbers of supporters, in both the world's older and newer democracies. This effort to renew democratic politics is widely seen as a reaction to the dominance of liberal constitutionalism. But many questions surround this new project. What does deliberative democracy stand for? What difference would deliberative practices make in the real world of political conflict and public policy design? Sunstein, Michael Walzer, and Iris Marion Young, and the editor of the volume, Stephen Macedo. The book concludes with a thoughtful response from Gutmann and Thompson to their esteemed critics. The duty to protect patient welfare underpins undergraduate medical ethics and patient safety teaching. The current syllabus for patient safety emphasises the significance of organisational contribution to healthcare failures. However, the ongoing over-reliance on whistleblowing disproportionately emphasises individual contributions, alongside promoting a culture of blame and defensiveness among practitioners. Diane Vaughan’s ‘Normalisation of Deviance’ provides a counterpoise to such individualism, describing how signals of potential danger are collectively misinterpreted and incorporated into the accepted margins of safe operation. NoD is an (...) insidious process that often goes unnoticed, thus minimising the efficacy of whistleblowing as a defence against inevitable disaster. In this paper, we illustrate what can be learnt by greater attention to the collective, organisational contributions to healthcare failings by applying NoD to The Morecambe Bay Investigation. By focusing on a cluster of five ‘serious untoward incidents’ occurring in 2008, we describe a cycle of NoD affecting trust handling of events that allowed poor standards of care to persist for several years, before concluding with a poignant example of the limitations of whistleblowing, whereby the raising of concerns by a senior consultant failed to generate a response at trust board level. We suggest that greater space in medical education is needed to develop a thorough understanding of the cultural and organisational processes that underpin healthcare failures, and that medical education would benefit from integrating the teaching of medical ethics and patient safety to resolve the tension between systems approaches to safety and the individualism of whistleblowing. Contemporary debates within analytic philosophy regarding the relation between literature and philosophy focus on the capacity of some literary works to engage with philosophical problems. While some philosophers see literature as a welcome contribution to philosophy, or as an alternative to pursuing philosophical questions, some are more sceptical with respect to its capacity to tackle philosophical concerns. As a contribution to this debate, in this paper I look at similarities and dissimilarities between the two practices, with the aim of mitigating (...) some views which see them as too diverse to allow for literary treatment of philosophical issues. As points of contact, I focus on the shared thematic concerns of the two practices, i.e. on the fact that literature and philosophy both deal with issues that humans generally care for. I argue that both practices, despite the stylistic, linguistic and methodological differences in their approach, manage to fulfil ‘the recognition requirement’, namely, recognize and engage with those issues, situations and context of human predicament in the world which are in need of intellectual refinement. I then move on to dismiss arguments which purport to discredit literary treatments of philosophy on the basis of literature’s alleged subjectivity and emotional dimension, which are contrasted with philosophical objectivity and rationality. I end by emphasizing the impact of academic constraints on professional philosophy, in order to suggest that pursuing philosophical concerns is not an invention of the practice, but a natural inclination of reflective, inquisitive human mind. Breath is invisible and yet ever present and vital for living beings. The concept of invisibility in relation to breath operates in concrete and metaphorical ways to extend ideas about breath and breathlessness across disciplines, in clinical spaces and in life experience. Using a critical medical humanities approach, I demonstrate that the poverty of narrative accounts and language for breath outside the health context have had a crucial influence enabling clinically mediated interpretations and accounts to dominate. These third-person accounts are (...) important in the articulation of the ‘lived body’, but I balance this with a consideration of the subjective sensation of interoception, which has important implications for the visibility of breathlessness in both clinical and lay contexts. This article illustrates the rich potential of the subjects of breath and breathlessness within body studies and this special issue is a key step in making breath such an emergent topic. (shrink)

The cognitive ability to think about other people's psychological states is known as `mindreading'. This Element critiques assumptions that have been formative in shaping philosophical theories of mindreading: that mindreading is ubiquitous, underpinning the vast majority of our social interactions; and that its primary goal is to provide predictions and explanations of other people's behaviour. It begins with an overview of key positions and empirical literature in the debate. It then introduces and motivates the pluralist turn in this literature, which (...) challenges the core assumptions of the traditional views. The second part of the Element uses case studies to further motivate the pluralist framework, and to advocate the pluralist approach as the best way to progress our understanding of social cognitive phenomena. In this essay I clarify the status of claims about global justice and injustice which are increasingly voiced and accepted in our world. Such claims present a problem for political philosophy because until recently most philosophical approaches to justice assumed that obligations of justice hold only between those living under a common constitution within a single political community. I will argue that the context that generates obligations of justice is social structural processes rather than political institutions. Claims that obligations of (...) justice extend globally for some issues, then, are grounded in the fact that some social structural processes have global reach. (shrink)

Responsible Research and Innovation (‘RRI’) is a cross-cutting priority for scientific research in the European Union and beyond. This paper considers whether the way such research is organised and delivered lends itself to the aims of RRI. We focus particularly on international consortia, which have emerged as a common model to organise large-scale, multi-disciplinary research in contemporary biomedical science. Typically, these consortia operate through fixed-term contracts, and employ governance frameworks consisting of reasonably standard, modular components such as management committees, advisory (...) boards, and data access committees, to co-ordinate the activities of partner institutions and align them with funding agency priorities. These have advantages for organisation and management of the research, but can actively inhibit researchers seeking to implement RRI activities. Conventional consortia governance structures pose specific problems for meaningful public and participant involvement, data sharing, transparency, and ‘legacy’ planning to deal with societal commitments that persist beyond the duration of the original project. In particular, the ‘upstream’ negotiation of contractual terms between funders and the institutions employing researchers can undermine the ability for those researchers to subsequently make decisions about data, or participant remuneration, or indeed what happens to consortia outputs after the project is finished, and can inhibit attempts to make project activities and goals responsive to input from ongoing dialogue with various stakeholders. Having explored these challenges, we make some recommendations for alternative consortia governance structures to better support RRI in future. (shrink)

In this article, I outline three critiques of analytic philosophy; that it is irrelevant to individuals and society; unconstructive; and excessively technical. These critiques are linked to skepticism about the educational value of analytic philosophy. In response, I suggest that if analytic philosophy provides constructive guidance about prominent and pressing questions, then it holds potential educational value. I identify a body of prominent and pressing questions that are addressed by analytic philosophy as a discipline. Because analytic philosophy is often concerned (...) with the analysis of ordinary concepts, there is at least some potential educational value to analytic philosophy insofar as it provides guidance about the meaning of ordinary concepts that ground ordinary questions. Taking P. F. Strawson's paradigmatically analytic account of philosophy, I show that analytic philosophy can directly address ordinary questions in a constructive manner. Analytic philosophy is neither irrelevant, unconstructive, nor excessively technical. (shrink)

The pervasive use of contracts in healthcare is a source of unease for many healthcare ethicists and patient advocates. This commentary examines the use of such contracts with individuals in rehabilitation settings who have complex medical and behavioural issues. The goals of this paper are to examine the many factors that can lead to contract use, to discuss some legal and ethical implications of contract use, and to assess contract use in light of concerns about health equity. Personalised learning systems—systems that predict learning needs to tailor education to the unique learning needs of individual students—are gaining rapid popularity. Praise for educational technology is often focused on how technology will benefit school systems, but there is a lack of understanding of how it will affect the student and the learning process. By uncovering what the meaning of ‘personal’ is in educational philosophy and as embodied in the technology, we illustrate that these two understandings are different regarding the autonomy (...) of the student. Personalised learning technology, therefore, bears the risk of failing to achieve its educational ideal of what personalisation should be. We also illustrate how personalised learning technology effects student autonomy by requiring the intensive tracking of the learning process, exposing them to privacy and data protection risks. We do not claim that education does not need technology, but we want to illustrate the importance of values as drivers of innovation. (shrink)

Radi se o stanovitim otklonima od normalnih slučajeva svjedočenja zbog kojih epistemička vrijednost takvih iskaza postaje dvojbena. Temeljem Coadyjeve analize komunikacijskih akata pokušale smo identificirati uvjete ne-patološkog svjedočanstva kako bismo propitale može li se fikcija smatrati svjedočanstvom. U članku argumentiramo u prilog stava da je moguće govoriti o fikcijskom svjedočanstvu jer praksa fikcije ne krši postavljene uvjete epistemičke odgovornosti govornika/autora; proizvodi epistemičku korist za čitatelja koja predstavlja legitimni (...) epistemički cilj. Theories of civil society do not adequately distinguish the functions of private, civic, and political associations. A public sphere arising from free associational life both holds power accountable and produces new ideas. Democratic processes that aim to promote justice, however, also require strong state regulatory institutions.

Residential racial and class segregation produce or exacerbate distributive injustice and political exclusion. Integration as the dispersal of a concentrated minority among the majority, however, often has its own harmful consequences. An alternative ideal of differentiated solidarity combines positive affinity grouping with non‐discrimination and regional government that encourages attention to shared problems and inequality.

The scope of issues of justice extends globally on many issues. Governance of global society therefore needs transformed institutions. A vision of global democracy assumes a relational model of self‐determination as non‐domination in the context of inclusive and stronger global institutions.
